This work consists in an analysis and systematization to the juridical and political situation of farmers and indigenous people in Mendoza city, Argentina, related to the defense of their territories. Considering the common heritage of Latin- American countries on their institutional history in which, after European colonization, the independent governments consolidate civil and criminal laws established over the private property, our work contributes to comprehend the phenomena around the region.
